LEGAL CLINICS FOR INDIVIDUALS CONSIDERING WHETHER TO APPLY FOR A NEW JERSEY DRIVER'S LICENSE

After years of advocacy by community groups throughout the State of New Jersey, the new driver's license law making licenses available to all qualified New Jersey residents, regardless of immigration status, will finally go into effect on May 1, 2021. It is estimated that the program could impact more than 737,000 people. In anticipation of the NJ Expanded Driver’s License Program going into effect, many individuals have questions and concerns regarding the risks they may face if they apply for a license. This is especially true for individuals who have previously applied for licenses in other states, who potentially used false or fraudulent information when applying for licenses, or who have prior immigration or criminal legal contact.

In order to help community members make informed decisions about applying for a New Jersey Driver's License under this newly enacted law, the Delaware-New Jersey National Lawyers Guild (DE-NJ NLG), in association with partner organizations Make the Road-New Jersey, the ACLU of New Jersey, and the New Jersey Alliance for Immigrant Justice, will be hosting a series of virtual legal clinics to try to help community members assess the potential risks and benefits of participating in the New Jersey expanded driver's license program.

Volunteer attorneys will join our upcoming legal clinics to meet with community members who are considering whether to apply for a New Jersey license in brief private consultations. The purpose of these confidential sessions is to help individuals assess risks and make informed decisions about the best path forward on the basis of their individual circumstances.

REGISTERING FOR AN INDIVIDUAL CONSULTATION

To register for a legal clinic, click the “Register” button at the top of this page. Provide all information requested in the registration form. When selecting legal clinic dates/times, please select all sessions that you are available to attend. This will help us as we try to schedule you for an available consultation time.

Due to the high demand for these consultations, we ask for your patience if it takes us some time to schedule you for an appointment. If you indicate your availability for a legal clinic that is already fully booked, we will place your name on a waiting list. If someone cancels their consultation, we may contact you to see if you would like to attend sessions that become available. While the organizations that are hosting these legal clinics will try to make individual consultations available to as many people as possible, we cannot guarantee that there will be available sessions for everyone who requests a session.

LEGAL CLINIC FORMAT

Each legal clinic will be comprised of two parts: a general information session followed by individual consultations.

The group presentation will provide a brief overview of the new NJ expanded access driver’s license program and the kinds of risk factors and other issues that community members way want to consider when deciding whether to apply for a license under the newly enacted law. During this group session, the purpose and meaning of the limited scope engagement letter will also be explained.

At the end of the group presentation, participants with pre-scheduled consultation appointments will be provided a link to an online waiting room. Participants who have scheduled appointments will be routed to online break-out rooms for a brief individual consultation with a volunteer attorney to discuss issues related to their individual circumstances.

LIMITED SERVICES AGREEMENT

At the beginning of the individual consultation, participants will sign a limited engagement letter. This retainer agreement creates a limited services relationship to protect the confidentiality of information that is shared during the consultation. This services agreement is limited to these one-time individual consultations. Neither participating attorneys nor the organizations that are hosting these legal clinics are agreeing to represent clinic participants in any capacity or to provide legal assistance after the legal clinic.

SCOPE AND PURPOSE OF INDIVIDUAL CONSULTATIONS

The scope of individual consultations offered in these legal clinics is limited to discussing potential risk factors and other considerations associated with applying for a NJ driver’s license under the new expanded access regulations. Volunteer attorneys will not discuss immigration status or other legal matters during these consultations. The purpose of these individual consultations is to help participants understand the potential risks and benefits of applying for a NJ driver’s license on the basis of their individual circumstances. The goal of these consultations is to help participants assess risks so that they can make informed decisions about whether to apply for a NJ driver’s license. Volunteer attorneys will not advise participants about what decisions they should make. Rather, they will try to provide participants the information they would need to make well-informed decisions for themselves.

IMPORTANT INFORMATION ABOUT CONFIDENTIALITY

IMPORTANT: It’s very important for participants to understand that the group presentation portion of these clinics is NOT confidential. Please do not share personal details about yourself, your immigration status, or your individual circumstances during the group presentation. Only the individual consultations with volunteer attorneys that occur after the limited engagement letter is signed are confidential.

SENIOR STAFF ATTORNEY, AMERICAN CIVIL LIBERTIES UNION OF NEW JERSEY
Farrin is a Senior Staff Attorney at the American Civil Liberties Union of New Jersey, where she conducts litigation and advocacy to advance the rights of immigrants and Muslim Americans.

From 2013 to 2017, Farrin was a Visiting Assistant Clinical Professor at Seton Hall University School of Law, where she taught in the Immigrants’ Rights/International Human Rights Clinic and the Latin America Rule of Law Program. She supervised law students on a wide variety of immigration matters, federal litigation challenging unlawful immigration detention, community lawyering projects, and the empirical report Deportation Without Representation: The Access-to-Justice Crisis Facing New Jersey’s Immigrant Families.

Farrin previously taught at the University of Miami School of Law Immigration Clinic and served as a Skadden Fellow at the American Civil Liberties Union Immigrants' Rights Project. She graduated from Yale College and Yale Law School and is a Director of the Refugee Reunification Project Fund. Farrin is the author of Due Process and Temporal Limits on Mandatory Immigration Detention, 65 Hastings L.J. 363 (2014).

Stanley Holdorf, Supervising Attorney, Delaware-New Jersey National Lawyers Guild Mass Defense Program & Prisoners Legal Advocacy Network (PLAN). Stanley’s grassroots organizing traces back to the summer of 1968 when he participated in a demonstration for the release of Black Panthers Co-Founder Huey P. Newton. Then a law student at Stanford, the unexpectedly violent turn of that action galvanized Stanley’s belief in the critical importance of mass defense for the protection of protesters’ rights.

Following his graduation from Stanford Law School in 1969, Stanley engaged in alternative service as a conscientious objector to the Vietnam War.

He then worked in corporate law, training every department in his firm in the non-discrimination requirements of Title VII of the Civil Rights Act of 1964. Through this work, Stanley worked with corporate personnel ranging from factory floor supervisors to corporate board members and the company’s President to assure that all employees’ rights pursuant to the newly enacted Civil Rights Act were swiftly and comprehensively observed.

Beginning in 2001, Stanley reported to the Executive Director of Trial Lawyers Care as TLC’s Database Coordinator and Economic Loss Expert. In this role, Stanley helped recruit, train and assign trial lawyer volunteers from around the country to assist victims of the 9/11 attacks and surviving family members in their efforts to exercise their rights under the law to access financial relief through the federal Victim Compensation Fund (VCF). TLC remains the largest pro bono legal initiative in the history of the United States, logging the hourly equivalent of approximately 100 years of volunteer lawyer services. VCF’s adoption of Stanley’s proposed revision to the economic eligibility formula increased survivors’ access to financial relief. By adding non- monetary income such as victims’ union benefits to the calculation of lost salaries, Stanley’s proposal rendered the distribution of federal funds more equitable for lower wage earners.

Since 2005, Stanley has served on the board of the National Family Court Watch Project, an initiative that assesses the family court system’s effectiveness in adjudicating cases, especially those that involve allegations of child abuse or other family violence, using an innovative legal observing model in court settings. Stanley recently co- authored “Eyes on the Family Court: Creating an Effective Data Collection Instrument,” which leads the Summer 2019 edition of Family & Intimate Partner Violence Quarterly. This article documents the findings of National Family Court Watch Project’s 15-year study of judicial treatment of (frequently pro se) litigants who allege domestic violence or child abuse in family court proceedings compared to the court’s treatment of litigants who do not. Stanley has presented findings of this study, which covered over 600 court cases in six states, at a variety of professional conferences including the Battered Mothers Custody Conference (BMCC) and the Institute on Violence, Abuse and Trauma (IVAT).

In 2009, Stanley expanded his pro bono practice to include legal advocacy in the area of prisoners’ rights, with an emphasis on service to incarcerated individuals whose charges arise from their political activism or efforts to defend themselves or their children from family violence, or whose convictions are the arguable result of racial bias. Stanley helped re-establish the Delaware-New Jersey National Lawyers Guild in 2015. In addition to chairing the Delaware-New Jersey NLG, Stanley also serves as supervising attorney for the Delaware-New Jersey NLG’s Mass Defense Program and Prisoners Legal Advocacy Network.

Since 1994, Stanley has also served as registrar for the Khirbat Iskandar archaeological expedition in Jordan. He co-wrote and co- edited the 2010 volume entitled, Khirbat Iskandar: Final Report on the Early Bronze IV Area C “Gateway” and Cemeteries, which shared the Biblical Archaeology Society’s 2011 Award for Best Scholarly Book on Archaeology.

Cameryn Hinton, Supervising Attorney, Pro-Active Coalition and Litigation Practice, Delaware- New Jersey National Lawyers Guild’s Mass Defense Program. Cameryn is presently an Associate in the Litigation Department of Greenbaum, Rowe, Smith and Davis LLP. Her practice focuses on commercial litigation and administrative law.

Prior to joining the firm, Cameryn served as a Deputy Attorney General with the New Jersey Division of Law in the Personnel, Community Affairs and Elections Section. In that role, she represented and advised the Department of Community Affairs and the Department of State in state contracting, tort liability, employment and regulatory enforcement actions, appearing before all three levels of the New Jersey Judiciary.

As an active member and past President of the Association of Black Women Lawyers (ABWL) of New Jersey, Cameryn has led a variety of special initiatives for the organization, most notably establishing the Young Lawyers Division and its Annual Law Student Forum for Professional Development. Cameryn is the 2019 recipient of the Professional Lawyer of the Year Award from the Association of Black Women Lawyers of New Jersey and the New Jersey Commission on Professionalism in the Law.

Cameryn’s commitment to ABWL stems from her love of creating a positive community for future black leaders and her penchant for organizing fellowship among minorities. In her undergraduate career at Stevens Institute of Technology, she served as President of the Black Student Union for two years and led the organization in cross- cultural awareness programming and volunteerism at the Hoboken Boy and Girls Club. Cameryn spent a summer studying with Seton Hall Law School’s Pre- Legal Institute and the following summer studying European Politics in Great Britain. She returned to finish her degree in Business and Technology and became a chartering board member of the Stevens Law Society. Upon entering law school at Rutgers University School of Law-Newark, Cameryn was elected 1L Representative for the Student Bar Association and earned a position on the Rutgers Computer and Technology Law Journal. Raised in Piscataway, NJ, she is undoubtedly, a proud “Jersey Girl.”

Cameryn is Supervising Attorney for the litigation practice and Pro-Active Coalition of the Delaware-New Jersey National Lawyers Guild. This role affords her unique opportunities to combine her love of mentoring young lawyers with her community-building experience. In this capacity, Cameryn supervises law student clerks and mobilizes pro bono legal service providers to help New Jersey residents exercise their rights of free expression without fear of reprisal.

Tanya Kitaigorovski, Supervising Attorney, Legal Research, Analysis & Publications Practice, Delaware-New Jersey National Lawyers Guild’s Mass Defense Program. Tanya is an attorney at a fortune 500 company in New York City. Tanya previously served as a Deputy Attorney General with the New Jersey Division of Law in the Pensions and Financial Transactions Section. During her time as a Deputy Attorney General, Tanya represented various governmental entities in administrative hearings, superior and appellate courts.

Tanya graduated from the Seton Hall University School of Law, where she was the Research Assistant for the school’s conflict management program, in which capacity she was responsible for liaising with the Southern District of New York, the District of New Jersey and the Financial Industry Regulatory Authority to secure representation for pro se plaintiffs and defendants. During her time at Seton Hall, Tanya also served as the President of the Student Veterans Association.

Tanya holds a Bachelor’s degree in Accounting and Business Administration from Truman State University in Kirksville, Missouri and a Master’s degree in Accounting and Financial Management from the University of Maryland. She is fluent in four languages: English, Russian, Hebrew and Ukrainian.

In her capacity as a Supervising Attorney for the Legal Research, Analysis & Publications Practice of the Delaware-New Jersey National Lawyers Guild’s Mass Defense Program, Tanya assists with public records requests and the compilation of the DE-NJ NLG Mass Defense Program’s Legal Monograph Series, “Legal Compendia for Community Organizers and Activists,” which will be available to the public on the DE-NJ NLG website.

Matt is licensed to practice law in New Jersey and the U.S. District Court, District of New Jersey. He is a Member of the New Jersey Bar Association, the Young Lawyers Division and the Ocean County Bar Association.

In 2013, Matt graduated magna cum laude from the University at Albany – State University of New York where he received a B.A. in Criminal Justice and Communications & Rhetoric. While an undergraduate, Matt was a member of UAlbany’s Division 1-FCS Football team, which won two conference championships and went to the 2011 FCS Playoffs. As a leader, Matt was the only student-athlete who was a member of MenREACH, a sexual assault awareness group that conducted presentations during freshman orientation and quarterly “open house” meetings which invited students to share any issues occurring in the dorms in an effort to help the students feel more comfortable in their new living environments.

Interests in civil rights and the Constitution combined with a desire to help others led Matt to law school. He received his law degree from the Seton Hall University School of Law in 2018. While studying at Seton Hall, Matt was a 1L student mentor for two years, the Treasurer of the Health Law Forum and a member of the Employment Law Forum. During law school, Matt worked as a Law Clerk at the National Labor Relations Board, a plaintiff’s-side employment litigation firm, the General Counsel of the City of Hoboken and two General Counsels of private companies. After graduation, Matt had the privilege of serving as a Judicial Law Clerk for the Honorable Patricia B. Roe, J.S.C., in the Ocean County Superior Court of New Jersey.

Following his Clerkship, Matt worked for McGovern Legal Services, LLC representing Home Owners’ Associations. Matt is presently an Associate Attorney at the Law Offices of Robert S. Gitmeid & Associates, PLLC, where he practices consumer advocacy by defending debtors’ rights against credit card companies.

In Matt’s spare time, he volunteers with the National Lawyers Guild, which enables him to pursue his passion for pro bono work by fighting to establish a world where everyone lives a life of equal opportunity, not in theory but in actuality. Matt is a Supervising Attorney and Executive Committee Member for the Legal Research, Analysis & Publications Practice of the Delaware-New Jersey National Lawyers Guild’s Mass Defense Program. DE-NJ NLG SUPERVISORY SENIOR LAW CLERK
Kaitlyn Michalek is a 2L at Widener University Delaware Law School. She received her Bachelor’s and Master’s degrees in Criminal Justice at West Chester University. Prior to entering law school, Kaitlyn worked for the Chester County District Attorney’s Office in West Chester, Pennsylvania. She is an active leader in the LGBTQ+ community in her personal life and on campus, where she serves as the OUTlaw Vice President. Kaitlyn is passionate about social justice work and hopes to pursue a legal career in advocacy and equity. She is interested in intersections of law, activism and civil disobedience. Kaitlyn believes we are at a pivotal moment in our society and that it is necessary for all of us to take a stand. She wants to integrate her social justice work with her passion for the law.

Kaitlyn first contributed to the NLG as a summer law clerk for the Delaware-New Jersey National Lawyers Guild working with the arrest hotline. She is now serving as a Senior Clerk for the Delaware-New Jersey National Lawyers Guild’s Legal Research, Writing and Publications Practice. In that role, she has drafted Open Public Records Act (OPRA) requests as part of an investigation into the conduct of officers of a New Jersey Police Department. She has also interviewed affected persons and worked with them to execute affidavits attesting to their experiences. Kaitlyn presented about her Practice Group’s work at a Continuing Legal Education Program at the 2020 NLG National Convention.

DE-NJ NLG SENIOR LAW CLERK
Lisa Ruan is a third-year law student at Widener University Delaware Law School. Prior to entering law school, she majored in Legal Studies and received her Bachelor of Business Administration degree from Temple University’s Fox School of Business.

In Spring 2021, Lisa joined DE-NJ NLG, where she serves as a law clerk for the Legal Research, Writing and Publications Practice. In this role, she assists with public record requests and the DE-NJ NLG Mass Defense Program’s Legal Monograph Series, “Legal Compendia for Community Organizers and Activists.” She has also conducted pre-intake client calls to explain limited scope engagement letters to clients.

Aside from DE-NJ NLG, Lisa also served as a judicial extern to two Judges in the Delaware County Court of Common Pleas, provided free civil assistance to low- income individuals and families at multiple public interest organizations, and served as both a Research Assistant and Teaching Assistant at Widener University Delaware Law School. Additionally, she is actively involved with several organizations including the Delaware Law School NLG Student Chapter, Phi-Alpha Delta Law Fraternity, Asian Law Students Association, Women’s Law Caucus, and First-Generation Law Student Association.
