Terms of Enforcement: Limitations of Platform Liability

About This Webinar

Online platforms have become a central arena for how intellectual property issues arise and are addressed in the digital ecosystem. Across social media, marketplaces, and emerging digital services, platforms, rights holders, and users operate within systems that enable large-scale distribution but also introduce new challenges in detecting and addressing infringement. At the same time, evolving technologies, including AI-enabled tools, are adding further complexity to how IP rights are monitored and enforced. In this webinar, Liz McLean of Sidley Austin will examine how the law governing platform liability for IP infringement is developing and how these legal frameworks shape enforcement strategies across digital platforms, including:
* Key legal principles governing platform liability for copyright and trademark infringement
* The role of intermediary liability regimes in shaping enforcement options and platform risk exposure
* How platform policies and notice-and-takedown processes function in practice
* Strategic considerations when pursuing takedowns and other platform-based remedies
* Practical challenges in policing infringement at scale across digital marketplaces and content platforms
