We look at the key legal concerns for First Nations employers regarding return to work, including the impact of new and existing health and safety regulations and the need to update workplace policies, protocols and contingency plans. We will also discuss managing absenteeism relating to refusal to return to work, positive COVID-19 testing (and screening/clearance considerations when the employee returns), and childcare-related responsibilities and restrictions.
