The purpose of this course is to educate Texas escrow officers, abstractors, examiners, and other title insurance professionals on the effect of voluntary and involuntary liens when issuing a title insurance policy. The course covers the definitions and types of voluntary liens (deeds of trust, vendor’s liens, mechanic’s lien contracts, and UCC fixture filings), involuntary liens (judgment liens, broker’s and appraiser’s liens, child support liens, mechanic’s lien affidavits, owelty liens, HOA liens, and restitution liens), federal liens (judgment liens and federal tax liens), and county, municipal, and state liens (ad valorem tax liens, paving liens, weed and sanitation liens, dangerous structure liens, and water/sewer system liens). For each category, the course discusses statutory limitations and underwriting guidelines pertaining to the curative aspect of the specific liens. The course also covers general lien principles applicable to all categories. Knowledge of different types of liens is vital to the issuance of title insurance policies and reduces the risk associated with outstanding liens.
