SAME SB Council Webinar: Suspensions, Terminations, Nonpayment, Oh My! A Contractor’s Survival Guide to EO-/DOGE-Related Impacts

About This Webinar

With Executive Orders flying fast and furious, DOGE Indicatives impacting a number of contracts, and contracting offices across agencies and industries struggling to keep up, it sure has been an interesting time to be a federal government contractor. Many contractors in recent months have experienced contract suspensions or received stop work orders, have been terminated for default, or have experienced issues regarding non-payment. Modifications are also increasingly common, as are the incursion of unanticipated costs or delays. If you have experienced any of these things, and are confused about what to do next, rest assured that you are not alone. But neither are you without recourse or resources.

In this webinar, you will walk through how to survive suspension and termination actions, and how to make sure you can recoup the money you are owed. Discussion will include: key strategies for primes and subs, the ways in which they should be cooperating in these fast-moving times, actions primes may be able to take in relation to unpaid invoices, and how to avoid common pitfalls relating to contract modifications. Potential claims arising from EOs and DOGE Impacts will also be covered, as will ongoing legal developments regarding EOs.

Learning Objectives:
- Identify your rights and obligations as a prime when suspended or after receiving a stop-work order
- Navigate a termination for convenience and recoup all allowable costs
- Understand key areas of prime/sub communication and cooperation in the context of suspensions and terminations
- Familiarize yourself with remedies and recourse relating to unpaid invoices undisputedly due and owing
- Identify potential claim bases arising out of EOs and DOGE impacts

Who Should Attend:
- Any contractor who is experiencing issues relating to suspension, termination, non-payment, modifications, and/or EO/DOGE-related impacts, or any contractor who wants to be prepared in case they experience these things in the near future
