Both the United States Supreme Court and the New Jersey Supreme Court have issued significant rulings in recent months addressing issues related to Miranda warnings. This Executive Briefing will address the importance and practical effects the New Jersey Supreme Court’s recent decisions in State v. O.D.A.-C.; State v. Sims; and State v. Ahmad, all of which strengthened the protections from Miranda for suspects being interrogated by law enforcement officers in New Jersey. We will also discuss the United States Supreme Court’s June decision in Vega v. Tekoe, where the Court held that a Miranda violation does not automatically give rise to a civil rights claim.
