On March 2, Johnson & Johnson petitioned the U.S. Supreme Court to review a Missouri appeals court decision that upheld one of the largest product liability verdicts in American history and awarded $2.1 billion in compensatory and punitive damages to 22 plaintiffs.

The case shines a light on critical legal issues that routinely arise in mass-tort litigation: claims joinder, punitive damages, and personal jurisdiction. Above all, it raises concerns about defendants’ due-process rights and their ability to receive a fair trial. Sherman Joyce is President of the American Tort Reform Association, the nation’s first organization exclusively dedicated to reforming the civil justice system.
