Robert McLusky

Member, Jackson Kelly

Robert G. McLusky is a Member in Jackson Kelly's Environmental practice
group, focusing on natural resources and environmental litigation. He practices
out of the Firm’s office in Charleston, West Virginia. Bob has been practicing environmental law at Jackson Kelly for more than three decades, so there isn’t much he hasn’t seen. He has seen the genesis and evolution of some of the most complicated environmental regulations, giving him the type of experience that can only be learned through practice. Bob’s practice focuses on energy development and infrastructure permitting and environmental litigation in West Virginia and surrounding states. He has represented manufacturing and energy ventures in a broad range of environmental issues, including defending Clean Water Act (CWA)
enforcement actions in federal court for Fortune 500 companies.

Bob’s love for his work and concern for his clients and cases extends to every minute of the day. In fact, he once was so eager to come to work, he accidentally showed up on a holiday and wondered where everyone was. This dedication has earned him numerous recognitions, including as the “Top Environmental Lawyer” in West Virginia in the 2011 edition of
Chambers USA.

He has defended Clean Water Act “fill” permits from challenges under the National Environmental Policy Act (NEPA) and the CWA, advised “linear” energy projects on NEPA and Endangered Species Act (ESA) compliance, and defended NPDES, waste, mining, quarry, and air permits. His work has also included CERCLA cleanup actions, internal investigations of environmental compliance, environmental permitting strategies, and “Brownfields” projects to rehabilitate contaminated properties.

He has been listed in Woodward/White’s The Best Lawyers in America® since 1993, Chambers and Partners in the Natural Resources and Environmental Law practice area, and West Virginia Super Lawyers. Bob is a frequent speaker and writer and is a past president of the Energy & Mineral Law Foundation.

At home on the West Virginia waters, Bob enjoys whitewater canoeing and paddle-boarding in his spare time.
Timothy Hagerty

Member, Frost Brown Todd

Tim counsels the Firm’s clients on environmental compliance, liability, and litigation issues arising under federal, state, and local laws, with an emphasis on natural resources law.
Tim assists clients in obtaining wetlands and wastewater discharge permits and related approvals under the federal Clean Water Act and similar state and local laws. He has extensive experience assisting public and private clients in complying with the National Environmental Policy Act (NEPA) and related resource review requirements. He provides advice to clients concerning the requirements of the Clean Air Act, the Endangered Species Act, and the National Historic Preservation Act.
Tim has both provided compliance counseling and represented clients in litigation concerning major electric transmission line and petroleum pipeline projects, large-scale residential and commercial developments, and major highway and transit projects throughout the country. He also has counseled the firm’s mining industry clients in various matters arising under federal environmental laws, and he recently represented a major coal company in federal litigation regarding the regulation of surface mining under the Clean Water Act.
Tim also assists the Firm’s clients in conducting environmental due diligence, negotiating environmental provisions in complex corporate and real estate transactions, and addressing property contamination issues.

Ted Boling

Partner, Perkins Coie

As an associate director at the President’s Council on Environmental Quality (CEQ), Edward (Ted) Boling served as the country’s top National Environmental Policy Act (NEPA) attorney. He currently advises clients on the development of renewable energy, resource development, transportation, and infrastructure, drawing on over 30 years of high-level public service.
Ted served in the U.S. Department of the Interior (DOI), CEQ, and the U.S. Department of Justice (DOJ) in both Democratic and Republican administrations. His experience includes deep involvement in federal infrastructure issues, as well as leadership of the first comprehensive revision of CEQ’s NEPA regulations in 40 years.
Ted’s work at CEQ also included the National Ocean Policy, CEQ’s climate change guidance, and the regulatory response to the Deepwater Horizon disaster. He drafted NEPA guidance on mitigation and monitoring, cumulative impacts analysis, and the development categorical exclusions from detailed NEPA documentation. Ted advised on the establishment of numerous national monuments, including the first marine national monuments in the United States and the largest marine protected areas in the world. He also assisted in briefing three U.S. Supreme Court cases.
At DOI, Ted handled matters involving energy development on the outer continental shelf, including offshore wind power development, and the fast track for solar and wind energy projects on public lands. He has provided legal and policy advice on environmental issues concerning the Federal Columbia River Power System and the California Central Valley Project.
At DOJ, in the first 10 years of his career, Ted litigated significant cases involving NEPA, endangered species, marine mammals, wetland protections, and public lands. He was involved in litigation concerning the Northwest Forest Plan, National Forest management decisions, and Federal Transit Administration decisions in New England.
Thomas Jensen

Partner, Perkins Coie

Thomas (Tom) Jensen provides strategic regulatory counsel, litigation support and legislative advocacy to clients in the environment, energy and natural resources sectors. With considerable experience in and deep knowledge of environmental and resources law, Tom delivers sophisticated counsel to clients involved with energy and water pipelines, electric transmission projects, transportation facilities, hydropower and other energy generation assets, and other capital-intensive infrastructure projects. Tom currently serves as lead outside regulatory and litigation counsel to a major interstate natural gas pipeline project and recently led the successful permitting and siting effort for a 500 kV interstate electric transmission project.
A nationally recognized practitioner of natural resources and environmental law, Tom advises clients throughout the business, government and nonprofit sectors, reflecting his credentials not only in the legal industry, but also in the public sector. He served as the majority counsel to the U.S. Senate Committee on Energy and Natural Resources and was the associate director for natural resources on the White House Council on Environmental Quality. He has also written numerous pieces of legislation that have been enacted into federal law and has published and lectured widely in the field.

Lisa Bruderly

Shareholder, Babst Calland

Lisa Bruderly is a shareholder and chair of the Environmental Group of Babst Calland. She is also a member of the Firm’s Energy and Natural Resources Group. Ms. Bruderly primarily focuses on regulatory issues associated with natural gas development, water resources and wastewater management. She works with industrial clients, including natural gas producers, on a daily basis regarding water-related issues, such as wetland and watercourse permitting and mitigation, NPDES permitting, spill prevention and response, and wastewater disposal. On behalf of her clients, Ms. Bruderly regularly negotiates with the U. S. Environmental Protection Agency and the Pennsylvania Department of Environmental Protection. As a former environmental auditor and compliance project manager for a large natural gas transmission company, Ms. Bruderly relies on both her knowledge of the law, as well as her prior technical experience to assist her clients with their complex compliance issues.

Ms. Bruderly is a member of the Energy and Mineral Law Foundation, the Marcellus Shale Coalition and the Pennsylvania Independent Oil and Gas Association (PIOGA). She is also a past President of the Appalachia Chapter of the Women’s Energy Network and the co-author of the “Pennsylvania Oil and Gas Law” chapter contained in the Pennsylvania Bar Institute’s Environmental Law and Practice reference book.
Brooks Smith

Brooks is managing partner of Troutman Pepper’s Richmond office, which has over 130 attorneys spread out over the full array of practice areas, as well as the Strategies group, which is the firm’s full-service government relations subsidiary. Brooks helps to lead the firm’s environmental and natural resources practice group, which spans offices from coast to coast. Prior to joining Troutman in August 2013, Brooks co-chaired the global environmental practice at Hunton & Williams (now Hunton Andrews Kurth). Brooks is widely recognized for his work, both locally and nationally. He is top ranked by Chambers USA, Best Lawyers, Super Lawyers and the Virginia Legal Elite. Megan Haines

Partner, Reed Smith

Megan is an experienced energy litigator and environmental regulatory lawyer who helps clients meet their operational needs and manage risk. She has led numerous high-profile energy litigation and environmental regulatory matters in state and federal courts and before state and federal agencies. Megan has also counseled clients through environmental regulations, environmental issues including due diligence in acquisitions and transactions, state energy regulatory commission proceedings, and municipal zoning matters impacting real estate development and commercial transactions.
From 2013 to 2018, Megan served as an adjunct professor at her alma mater, Duquesne University School of Law, where she instructed Oil & Gas Law. She is also a frequent lecturer on energy and environmental topics and serves on the planning committee for the Pennsylvania Bar Institute’s annual oil and gas law conference.
Ryan Elliott

Ryan is an associate in the Columbus office and a member of the energy and environmental group. He counsels clients on a wide variety of environmental matters including federal and state air, water and waste regulatory permitting. Ryan also assists clients involved in the development of the Utica Shale.
Ryan is a member of the Columbus, Ohio and American Bar Associations and serves on the Ohio State Bar Association’s Environmental Law Committee. He is also a member of the Ohio Oil and Gas Association.
Ryan received his J.D. cum laude from Capital University Law School, where he was member of the Order of the Curia and the Order of the Barristers. He received his B.A. from Miami University.

Kevin Garber

Shareholder, Babst Calland

Kevin Garber is a shareholder in the Environmental and Energy and Natural Resources groups of Babst Calland, practicing out of the firm’s Pittsburgh and State College offices. Mr. Garber concentrates much of his practice in the areas of natural resources law and water law. He represents mining and oil and gas companies, including those developing unconventional gas reserves, on a broad range of environmental issues including permitting, water supply and treatment and resource development. Mr. Garber has extensive environmental litigation experience representing clients before the Environmental Hearing Board in Pennsylvania and in trial and appellate courts. In administrative proceedings, he has represented clients challenging permits, contesting civil penalties and compliance orders, and defending against challenges brought by citizens’ groups, among other matters. Mr. Garber regularly counsels oil and gas production, midstream, storage and transportation companies on federal, state and local environmental regulations affecting their operations, and he negotiates environmental provisions in transactions involving natural resources. He counsels mining clients on a wide range of environmental matters affecting the mining industry, such as water and air permits, bonding and treatment trusts. Mr. Garber also regularly handles NPDES permitting matters and appeals; defends citizens’ suits under the federal Clean Water Act and similar state laws; and represents landowners and others with respect to groundwater protection issues. He leads the firm’s municipal environmental services practice area in which a substantial part of his practice concentrates on sewage facility planning and permitting, storm water management and related development issues facing developers, municipalities and municipal authorities. He serves as special environmental counsel to many municipalities, authorities and developers in western Pennsylvania.
Mr. Garber’s practice also covers the cleanup and redevelopment of industrial sites under federal and state hazardous waste and brownfields laws. In Pennsylvania, for example, he regularly counsels clients in the purchase, sale and cleanup of property using Act 2 to address environmental concerns. He also conducts and reviews environmental audits of various types of industrial, commercial and mining properties for buyers, sellers, lenders and trustees, and negotiates environmental provisions of transactions, contracts and deeds.
In addition, Mr. Garber also practices intellectual property law. He is a registered patent attorney and prosecutes trademark applications before the U.S. Patent and Trademark Office.

Mr. Garber graduated with Distinction from The Pennsylvania State University with a B.S. in Biology, took his M.S. in Oceanography and Limnology from the University of Wisconsin, his Ph.D. in Ecology from the University of Pittsburgh, and his law degree from the Duquesne University School of Law, where he was a member of the Duquesne University Law Review. Mr. Garber’s graduate and doctoral work researched point and non-point source pollutant loadings to lakes and the development of remedial alternatives.

Mr. Garber is admitted to practice in Pennsylvania and various federal courts and before the United States Patent and Trademark Office. He is a member of the Allegheny County, Pennsylvania and American Bar Associations, and has served on the Council of the Pennsylvania Bar Association’s Environmental, Mineral and Natural Resources Law Section. Mr. Garber is a past Chairman of the Environmental Section of the Allegheny County Bar Association.
Mr. Garber has been ranked among Pennsylvania’s top environmental lawyers in Chambers USA’s America’s Leading Business Lawyers since 2004. Mr. Garber serves on the boards of directors of the Greater Pittsburgh Chamber of Commerce, the Pennsylvania Environmental Council and the 3 Rivers Wet Weather Demonstration Program, an Allegheny County non-profit entity which is helping to coordinate a regional response to wet weather water quality issues in the County. He is a former board member and past chairman and president of the Board of Directors of the Allegheny Land Trust, and a former board member of the Local Government Academy.
Karen J. Greenwell

Karen Greenwell is a member of the Firm’s Executive Committee and a Co-Team Leader of the Natural Resources & Environmental Service Team. She concentrates her practice in the areas of mineral, energy and property law, and commercial litigation.

With 30 years of legal experience in the mineral and energy industry, Ms. Greenwell has assisted coal, oil, gas and energy industry clients with all manner of transactions, including leasing matters, asset acquisitions and divestitures, corporate mergers and stock acquisitions, and bankruptcy sales. Ms. Greenwell’s experience in litigating property, contract and business tort disputes, as well as in other types of commercial litigation, gives her an unusual breadth of experience and perspective in dealing with issues affecting mineral and energy industry clients.
Ms. Greenwell is a Trustee of the Energy & Mineral Law Foundation, a director of the Kentucky Oil and Gas Association, an adjunct professor at the University of Kentucky College of Law, and a frequent speaker and author on energy topics for organizations such as the Energy and Mineral Law Foundation, the Rocky Mountain Mineral Law Foundation, the Institute for Energy Law, and the Conference of Government Mining Attorneys.

Gary Slagel

Government Affairs Specialist, Steptoe & Johnson

Gary Slagel, who most recently retired as the Senior Advisor of Environmental Affairs for CONSOL Energy, has joined the firm as a Government Affairs Specialist. Mr. Slagel is an engineering graduate from the University of Dayton and spent 35 years with CONSOL and CNX Gas in several capacities including Director of Environmental Regulatory Affairs and later Director of Government Affairs working on both coal and natural gas issues. In his most recent position, Mr. Slagel was asked to redirect his talents to addressing the increasingly complex issues associated with shale gas exploration and development.
Mr. Slagel has extensive legislative and regulatory experience including the four-year mediation effort that resulted in 1994 amendments to the original Pennsylvania Subsidence Act; the two-year mediation effort that amended the Pennsylvania Coal Refuse Disposal Act and the more recently, 2012 amendments to the Pennsylvania Oil and Gas Act. He remains intimately involved with all regulatory issues impacting natural gas development through his former role on the Pennsylvania Oil and Gas Technical Advisory Board and his current roles with the Marcellus Shale Coalition, and the West Virginia Oil and Natural Gas Association. He currently serves as Chairman and is on the Executive Committee of the Pennsylvania Independent Oil and Gas Association.
Lauren Bachtel

Senior Attorney, Hunton Andrews Kurth

A former US Department of the Interior and American Wind Energy Association lawyer, Lauren draws on her diverse experience to navigate clients through complex permitting and compliance issues that arise under a host of federal environmental statutes and regulations. She also advocates for clients during related administrative rulemakings and litigation.
Lauren has extensive experience with permitting and litigation under the National Environmental Policy Act (NEPA), Mineral Leasing Act (MLA), Endangered Species Act (ESA), Migratory Bird Treaty Act (MBTA), Bald and Golden Eagle Protection Act (BGEPA) and Outer Continental Shelf Lands Act (OCSLA). She also has significant experience representing clients on Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and hazardous waste matters.

She has represented energy industry coalitions on various regulatory and administrative matters before the Bureau of Ocean Energy Management (BOEM), the Bureau of Land Management (BLM), the US Fish and Wildlife Service (FWS) and the Federal Energy Regulatory Commission (FERC). Lauren has deep experience drafting comments on administrative rulemakings, advising clients on policy and regulatory clarifications and negotiating proposed legislative bills as well as with federal permitting and litigation. She also has advocated on behalf of energy clients regarding carbon policies and the repeal and replacement of the US Environmental Protection Agency’s Clean Power Plan.

As an Attorney-Advisor for DOI’s Office of the Solicitor, Lauren worked with BLM, FWS and the US Department of Justice (DOJ) on rulemakings, administrative actions and litigation that impacted the oil and gas and coal industries. That experience includes working on the oil and gas venting and flaring rules, the coal leasing moratorium and its associated programmatic environmental impact statement, and instruction memoranda implementing the agencies’ regulations. Along with assisting with DOI regulation implementation, Lauren also worked with BLM and DOJ on the environmental review and associated litigation for high-profile coal leasing matters throughout the country and counseled agencies on matters concerning the Surface Mining Control and Reclamation Act (SMCRA), CERCLA, OCSLA, the Freedom of Information Act (FOIA) and the Bankruptcy code.
Jon Beckman

Member, Steptoe & Johnson

Jon Beckman focuses his practice in the area of energy and natural resources law, specifically assisting clients with energy and environmental litigation. Jon draws on his mineral title and regulatory experience to assist clients with disputes over mineral ownership, royalties, and leasehold issues as well as environmental and regulatory matters. Additionally, he assists clients with eminent domain proceedings, construction litigation, midstream litigation, insurance litigation, and arbitration proceedings. Jon is a former Combat Trauma Specialist for the Pennsylvania Army National Guard and served in Operation Iraqi Freedom and is active in the firm's Veterans Inclusion Council. Mr. Beckman is the Managing Member of the firm's Meadville office.

Kathy Condo

Shareholder, Babst Calland

Kathy Condo is a shareholder in the Litigation Services Group of Babst Calland. Before joining the firm, Ms. Condo spent more than 25 years in the Pittsburgh office of a large national law firm, during which time she handled numerous jury and non-jury trials. She has extensive experience in handling toxic tort and products liability litigation in various federal and state courts, which has included trial work, as well as the multi-state coordination of the defense of repetitive litigation. During the course of her representation of clients in the toxic tort and product liability area, she has worked with and opposed numerous technical and medical expert witnesses. Her experiences include trying a toxic tort case for an international electronics manufacturer involving claimed injuries due to heavy metal exposure, and defending a class action complaint involving claimed environmental exposures. More recently, Ms. Condo has become involved in counseling clients in threatened toxic tort litigation related to Marcellus Shale development, and defending these cases when filed.

Ms. Condo also represents and counsels financial services institutions in litigation arising out of lending and servicing activities and in various commercial litigation matters, often resolving problems to prevent litigation or to resolve litigation after it is filed. She has also represented a number of major corporations in federal and state courts in employment-related matters.

For a number of years, Ms. Condo acted as an outside “in house counsel” for a corporation facing a major litigation challenge. In that capacity, she administered hundreds of cases in outlying jurisdictions, controlled the litigation budgets of local counsel, administered the day-to-day activity of paralegals and lawyers, negotiated settlements, and handled trials in local jurisdictions. Much of this work focused on innovative mechanisms for defense cost savings.

Ms. Condo graduated summa cum laude and first in her class from Duquesne University School of Law, with a J.D. in 1981, where she was Executive Recent Decisions Editor of the Law Review. She received her M.S.W. from the University of Pittsburgh in 1975 and upon graduation she worked as a social worker in the neonatal intensive care unit at Magee Women’s Hospital. Ms. Condo received her B.A., with high distinction, from the Pennsylvania State University in 1974, where she was selected for membership in Phi Beta Kappa.

Ms. Condo is admitted to practice in Pennsylvania and West Virginia, and is a member of the Allegheny County Bar Association. She has been a member of the Academy of Trial Lawyers since 1992. Ms. Condo was appointed by the Pennsylvania Supreme Court to serve a three-year term on the Pennsylvania Civil Procedural Rules Committee. She has also been a member of the Allegheny County Private Industrial Counsel as well as a past board member of the Sara Heinz House.
Ms. Condo is admitted to practice in Pennsylvania and West Virginia, and is a member of the Allegheny County Bar Association. She has been a member of the Academy of Trial Lawyers since 1992. She has also been a member of the Allegheny County Private Industrial Counsel as well as a past board member of the Sara Heinz House. Ms. Condo has been listed in The Best Lawyers in America© in the Commercial Litigation Section since 2020 by BL Rankings. She was also selected to the 2012-2018 Pennsylvania Super Lawyers lists (Thomson Reuters).

Over the years, Ms. Condo has spoken frequently at PBI, DRI and in-house CLEs on various subjects related to litigation, including Daubert challenges, recent developments in civil procedure and evidence, toxic tort litigation, Marcellus Shale development litigation and mitigation of litigation.
