LEGAL CLINICS FOR INDIVIDUALS CONSIDERING WHETHER TO APPLY FOR A NEW JERSEY DRIVER'S LICENSE

After years of advocacy by community groups throughout the State of New Jersey, the new driver's license law making licenses available to all qualified New Jersey residents, regardless of immigration status, will finally go into effect on May 1, 2021. It is estimated that the program could impact more than 737,000 people. In anticipation of the NJ Expanded Driver’s License Program going into effect, many individuals have questions and concerns regarding the risks they may face if they apply for a license. This is especially true for individuals who have previously applied for licenses in other states, who potentially used false or fraudulent information when applying for licenses, or who have prior immigration or criminal legal contact.

In order to help community members make informed decisions about applying for a New Jersey Driver's License under this newly enacted law, the Delaware-New Jersey National Lawyers Guild (DE-NJ NLG), in association with partner organizations Make the Road-New Jersey, the ACLU of New Jersey, and the New Jersey Alliance for Immigrant Justice, will be hosting a series of virtual legal clinics to try to help community members assess the potential risks and benefits of participating in the New Jersey expanded driver's license program.

Volunteer attorneys will join our upcoming legal clinics to meet with community members who are considering whether to apply for a New Jersey license in brief private consultations. The purpose of these confidential sessions is to help individuals assess risks and make informed decisions about the best path forward on the basis of their individual circumstances.

REGISTERING FOR AN INDIVIDUAL CONSULTATION

To register for a legal clinic, click the “Register” button at the top of this page. Provide all information requested in the registration form. When selecting legal clinic dates/times, please select all sessions that you are available to attend. This will help us as we try to schedule you for an available consultation time.

Due to the high demand for these consultations, we ask for your patience if it takes us some time to schedule you for an appointment. If you indicate your availability for a legal clinic that is already fully booked, we will place your name on a waiting list. If someone cancels their consultation, we may contact you to see if you would like to attend sessions that become available. While the organizations that are hosting these legal clinics will try to make individual consultations available to as many people as possible, we cannot guarantee that there will be available sessions for everyone who requests a session.

LEGAL CLINIC FORMAT

Each legal clinic will be comprised of two parts: a general information session followed by individual consultations.

The group presentation will provide a brief overview of the new NJ expanded access driver’s license program and the kinds of risk factors and other issues that community members way want to consider when deciding whether to apply for a license under the newly enacted law. During this group session, the purpose and meaning of the limited scope engagement letter will also be explained.

At the end of the group presentation, participants with pre-scheduled consultation appointments will be provided a link to an online waiting room. Participants who have scheduled appointments will be routed to online break-out rooms for a brief individual consultation with a volunteer attorney to discuss issues related to their individual circumstances.

LIMITED SERVICES AGREEMENT

At the beginning of the individual consultation, participants will sign a limited engagement letter. This retainer agreement creates a limited services relationship to protect the confidentiality of information that is shared during the consultation. This services agreement is limited to these one-time individual consultations. Neither participating attorneys nor the organizations that are hosting these legal clinics are agreeing to represent clinic participants in any capacity or to provide legal assistance after the legal clinic.

SCOPE AND PURPOSE OF INDIVIDUAL CONSULTATIONS

The scope of individual consultations offered in these legal clinics is limited to discussing potential risk factors and other considerations associated with applying for a NJ driver’s license under the new expanded access regulations. Volunteer attorneys will not discuss immigration status or other legal matters during these consultations. The purpose of these individual consultations is to help participants understand the potential risks and benefits of applying for a NJ driver’s license on the basis of their individual circumstances. The goal of these consultations is to help participants assess risks so that they can make informed decisions about whether to apply for a NJ driver’s license. Volunteer attorneys will not advise participants about what decisions they should make. Rather, they will try to provide participants the information they would need to make well-informed decisions for themselves.

IMPORTANT INFORMATION ABOUT CONFIDENTIALITY

IMPORTANT: It’s very important for participants to understand that the group presentation portion of these clinics is NOT confidential. Please do not share personal details about yourself, your immigration status, or your individual circumstances during the group presentation. Only the individual consultations with volunteer attorneys that occur after the limited engagement letter is signed are confidential.

FORMATO DE LA CLÍNICA LEGAL

ACUERDO DE SERVICIOS LIMITADOS

IMPORTANTE: Es muy importante que los participantes comprendan que la parte de la presentación que se hará en grupo en estas clínicas NO es confidencial. No comparta detalles personales sobre usted, su estado migratorio o sus circunstancias individuales durante la presentación grupal. Solo las consultas individuales con abogados voluntarios que sucederán después de que se firme la carta de acuerdo de servicios limitados serán confidenciales.
